Pennsylvania and New Jersey E-ZPass Transponder Billing Issues — Potential Class Action?

There have been various complaints by both Pennsylvania, New Jersey and other out of state drivers involving billing issues pertaining to their use of tolls and E-ZPass throughout the Pennsylvania Turnpike.

The Pennsylvania E-ZPass, an electronic toll collection program, is operated by the Pennsylvania Turnpike whereby drivers, after completing an application and establishing an account, receive a transponder, a “radio frequency transmitter device.” According to the Pennsylvania Turnpike’s Website, when drivers “travel through an E-ZPass lane, an antenna reads the transponder signal, registers the toll electronically and deducts the appropriate amount from your pre-funded E-ZPass account.”

Despite this seemingly advanced technology, a number of E-ZPass drivers and consumers have complained of double-billing, excessive-billing, and even billing for non-use of their E-ZPass. Other complaints have included various transponder errors where drivers have been excessively billed for another driver’s toll charges, often resulting in fines and additional charges to the innocent E-ZPass account holder.  In fact, there have been class actions filed in both Massachusetts and Rhode Island, alleging discriminatory and unfair billing practices involving E-ZPass.

    I have been using EZ Pass for well over 10 years now. I am a current EZ Pass user and travel on the PA Turnpike Mon-Fri. I received a collections letter yesterday regarding violations from May 2011. What can I do about this. I should not have to pay a large sum of money because there equipment does not work consistently.
