Our client’s baby suffered extensive brain damage due to the failure of the hospital and its doctors to diagnose the fact that her mother suffered from a sexually transmitted disease. Had the appropriate diagnosis been made, a C-section would have been performed, the baby would not have been exposed to the infection during vaginal delivery and therefore would not have developed meningitis several days later.
Key to the result we secured on behalf of our client was our ability to compel the health care providers to concede that our client presented at a prenatal visit with symptoms of an STD which they failed to properly investigate and diagnose. Rather than investigate, the providers instead merely performed a visual examination and wrote the lesion off as a benign condition that could be addressed after the baby’s eventual delivery. At deposition, the care providers were forced to admit that further work up should have been performed but was not, largely because the client was put into the hands of inexperienced residents who were not properly supervised by attending physicians.
